Non-pecuniary interest in respect of Minute 13 (S/0619/15/FL in Impington) as being acquainted with the applicant. Councillor Harford was coming to the meeting afresh.

Councillor Deborah Roberts

Non pecuniary interest In respect of Minute 5 (S/2822/14/OL in Foxton). Councillor Roberts was present when this application was discussed at Foxton Parish Council, but did not speak.

Councillor Sebastian Kindersley

Non-pecuniary interest as the local Cambridgeshire County Councillor for Barrington (Minute 7)). Councillor Kindersley had not spoken publicly about the application prior to this meeting.

Arrangements under Section 106 of the Town and Country Planning Act 1990

To receive a verbal update from the Interim Development Control Manager

Minutes:

The Interim Development Control Manager presented a verbal report about Regulation 123 of the Community Infrastructure Levy Regulations 2010 (as amended in 2014). He informed the Committee that, after 6 April 2015, a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 may not constitute a reason for granting planning permission if, since 6 April 2010, five or more separate planning obligations had been entered into, providing for the funding or provision of that project or type of infrastructure.

 

Committee members discussed the implications.

The Committee refused for the reasons set out in the report from the Planning and New Communities Director. Members asked that more substance be given to both reasons to reflect concerns raised by them in relation to the impact of development on the character of this part of the village, including that its Group Village status is reflected by the current visual character of this part of the village.

The Committee received and noted an Update on enforcement action. The following issues in particular were raised:

 

Hill Trees, Babraham Road, Stapleford

In response to some Members’ concern as to the period of time that had elapsed since first taking proceedings, the Senior Lawyer listed the numerous actions that had been taken during that time, and stressed the significant care and attention needed in properly dealing with a very complex matter.

 

Pear Tree Public House, Hildersham

An appeal had been received against the refusal of planning permission.

 

Arbury Camp / Kings Hedges Road

Enforcement Notices had been issued.
