Councillor Hazel Smith declared a personal interest as a member of Milton Parish Council which owns the access road to the application site.  Councillor Smith was present when the Parish Council discussed the matter, but was now considering the matter afresh.  She did not consider the interest to be prejudicial.

Councillor Deborah Roberts withdrew to the public gallery on the basis of legal advice that, were she to contribute to the consideration of the matter, any decision made could be challenged on the basis of bias.  Deferral was proposed by the Chairman and agreed without debate.

The Committee resolved that an Order be made under Section  257 of the Town and Country Planning Act 1990 to divert part of Public Footpath No.7, Horseheath, from A-B-E to A-C-D-E, as described in Cambridgeshire County Council’s Synopsis, and shown on the plan.. The width of the diverted route would be 2 metres.  The Committee further resolved that, should it be possible to gain the landowner’s  consent to divert the footpath from the line A-B-E-G to the line A-C-DF-G without delaying a diversion order then this should be done instead.
