Minutes:

There were no declarable interests.  Councillor Sebastian Kindersley stated that his Cambridgeshire County Council Electoral Division of Gamlingay included the parishes of Croydon and Orwell.

The Planning Enforcement Sub-Committee authorised the Chairman to sign, as a correct record, the minutes of the meeting held on 9 March 2010.

Decision:

The Planning Enforcement Sub-Committee deferred making a decision so that Members could undertake a site visit.

Minutes:

The Planning Enforcement Sub-Committee considered a report about unauthorised earth works that had raised land level to the rear garden of 9 High Street, Orwell.

 

The Planning Officer distributed a number of photographs of the site in order further to inform Members.

 

The developer’s father was present.  Although he had not registered to address the Sub-Committee, the Chairman exercised his discretion to allow him to make a short statement.

 

Members discussed the matter, focusing on concerns about land drainage, the possible impact on neighbours’ amenity by virtue of overlooking, and detrimental effect on the trees along the western boundary. 

 

The Head of Planning reminded Members about their duty to be satisfied  that all factors had been given due consideration and accorded the appropriate weight. 

 

Upon a proposal from Councillor Charles Nightingale, seconded by Councillor Sebastian Kindersley, the Planning Enforcement Sub-Committee deferred making a decision so that Members could undertake a site visit and gather that additional information they needed in order to reach a balanced decision.  Members asked that, when this matter returned to Planning Enforcement Sub-Committee, legal advice be available relating to the option of screening the site.

Decision:

The Planning Enforcement Sub-Committee resolved that, subject to consultation with Cambridgeshire Archaeology at Cambridgeshire County Council, no further action be taken. Members accepted that the development was rural in appearance and appropriate in terms of design, siting, scale and use. It was well screened by existing mature trees and hedges to mitigate its visual impact on the countryside.

 The Planning Enforcement Sub-Committee considered a report about the unauthorised erection of stables located at Portlet, High Street, Croydon.

 

The Planning Officer distributed a number of photographs and plans of the site in order further to inform Members.

 

Members noted that there had previously been a noise nuisance complaint relating to a mobile field shelter used for kennels kept elsewhere on the site.  The siting of this field shelter and the scale of its use as a kennels had previously been investigated and considered not to require planning permission.  Planning enforcement was therefore not an issue.  However, the Head of Planning said he would bring the noise nuisance complaint to the attention of Health and Environmental Services.

 

The Planning Enforcement Sub-Committee noted the absence of any archaeological investigation of the site prior to development, but accepted that such development enhanced the site’s security and, in itself, had not led to any anti-social activity.

 

The Planning Enforcement Sub-Committee resolved that, subject to consultation with Cambridgeshire Archaeology at Cambridgeshire County Council, no further action be taken. Further to Minutes 7 and 14 of the meetings on 26 January 2010 and 9 March 2010 respectively, the Enforcement Officer reported that, while work had commenced on site, the terms of the Remedial Notice, issued on 15 May 2007, had still not fully been complied with.

 

The Enforcement Officer reported that the owner’s recent poor health had been a factor, and that the Council had now been assured that the Remedial Notice would be complied with by the end of April 2010.
