Apologies

To receive apologies for absence from committee members. 

Minutes:

Councillors Pippa Heylings, Heather Williams and Nick Wright sent Apologies for Absence. Councillor Henry Batchelor substituted for Councillor Heylings.

 

In Councillor Heylings’ absence, and by affirmation, the Committee appointed Councillor Brian Milnes as Vice-Chairman for the meeting.

Declarations of Interest

 

1.         Disclosable pecuniary interests (“DPI”)

A  DPI is where a committee member or his/her spouse or partner has any kind of beneficial interest in the land under consideration at the meeting.

 

 2.        Non-disclosable pecuniary interests

These are interests that are pecuniary involving a  personal financial benefit or detriment but do not come within the definition of a DPI.  An example would be where a member of their family/close friend (who is not their spouse or partner) has such an interest.

 

3.         Non-pecuniary interests

Where the interest is not one which involves any personal financial benefit or detriment to the Councillor but arises out of a close connection with someone or some  body /association.  An example would be membership of a sports committee/ membership of another council which is involved in the matter under consideration.

Minutes:

Councillor Henry Batchelor declared a non-pecuniary interest in Minute 5 (S/0670/19/FL - Linton (Land Rear of 24-27 Paynes Meadow)). He had been present at meetings of Linton Parish Council at which this application had been discussed but was now considering the matter afresh.

He had been present at meetings of Linton Parish Council at which this application had been discussed but took no part in those discussions and was now considering the matter afresh.

 

With regard to Minute 6 (S/1782/19/FL - Stapleford (The Tree, 9 Bar Lane))

·         Councillor Peter Fane declared anon-pecuniary interest because he had supported calls for the Council to conclude a Compulsory Purchase Order in respect of The Tree. He withdrew to the public gallery, took no part in the debate and did not vote. He did however have a dispensation to address the meeting as a local Member.

·         Councillor Brian Milnes declared a non-pecuniary interest in view of his association with the history of this matter but was now considering the matter afresh.

·         Councillor Peter Topping declared a non-pecuniary interest because he had attended meetings on this topic but was considering the matter afresh.

·         Councillors Anna Bradnam, Martin Cahn, Brian Milnes and Judith Rippeth declared non-pecuniary interests by virtue of their previous consideration of The Tree’s Compulsory Purchase Order as members of the Scrutiny and Overview Committee.

Decision:

By six votes to two, with one abstention, the Committee refused the application, contrary to the recommendation in the report from the Joint Director of Planning and Economic Development. Members agreed the reasons for refusal to be design, adverse impact on the landscape, and location of the proposal being outside the village framework.

 

(Councillors Cahn and Fane voted to approve the application. Councillors Henry Batchelor, John Batchelor, Bradnam, Rippeth Roberts and Topping voted for refusal. Councillor Milnes abstained from voting.)

Members visited the site on 10 December 2019.

 

The case officer drew Members’ attention to the Landscape Officer’s objections and informed them that the sum referred to in paragraph 145 would be allocated to providing a new nursery classroom. He also corrected how the red line should appear on the site plan. Further Linton Parish Council comments and two additional neighbour representations had been received but these had already been addressed in the report. The case officer briefly referred to ongoing housing need in the village, read out Policy H/11 and assured that the proposed Legal Agreement under Section 106 of the Town and Country Planning Act 1990 would ensure appropriate maintenance of the Sustainable Urban Drainage System.

 

Mark Ganderton (objector) Hannah Northrop (applicant’s agent), and Councillor Enid Bald (Linton Parish Council) addressed the meeting. Councillor Henry Batchelor also spoke as one of the local Members.

 

During the ensuing debate, the following issues were raised:

 

·         Concern about intrusion into the countryside, design, and the impact on local character and landscape

·         Drainage

·         The distance to local amenities

·         The absence of any Section 106 money for primary and secondary education

By seven votes to one, the Committee approved the application subject to the Conditions and Informative set out in the report from the Joint Director of Planning and Economic Development.

 

Councillors Henry Batchelor, John Batchelor, Cahn, Milnes, Rippeth, Roberts and Topping voted to approve the application. Councillor Bradnam voted to refuse it. Councillor Fane did not vote.

William French (objector), Peter McKeown (applicant’s agent) and Councillor Kettel (Stapleford Parish Council) addressed the meeting. Councillor Peter Fane spoke as a local Member but not as a member of the Committee.

 

While there was some concern about configuration of the car park, other Members could see no reason to refuse the application.

 

By seven votes to one, the Committee approved the application subject to the Conditions and Informative set out in the report from the Joint Director of Planning and Economic Development.

 

Councillors Henry Batchelor, John Batchelor, Cahn, Milnes, Rippeth, Roberts and Topping voted to approve the application. Councillor Bradnam voted to refuse it. Councillor Fane did not vote.

By five votes to three, the Committee deferred the application to enable officers to consider and consult upon the plan submitted by the applicant detailing a revised proposed vehicular access.

Paul Hoayon (objector) and Emma Morrice (applicant) addressed the meeting.

 

Members had before them a detailed letter from the applicant together with a revised plan.

 

While several Members were minded to support the application, the Delivery Manager (Strategic Sites) reminded the Committee that the plan to which they were now being referred had not been submitted formally to the Council.

 

Councillor Anna Bradnam therefore proposed that the application be deferred. This was seconded by Councillor Brian Milnes and, by five votes to three, the Committee deferred the application to enable officers to consider and consult upon the plan submitted by the applicant detailing a revised proposed vehicular access.

 

(Councillors Henry Batchelor, John Batchelor, Bradnam, Cahn and Milnes voted to defer the application. Councillors Fane, Rippeth and Roberts voted against deferral, Councillor Topping was absent from the Chamber and did not vote.)

The Committee received and noted an Update on enforcement action.    

 

The Principal Enforcement Officer reported that the Council had now received a quote in respect of 9a Bridge Street, Whaddon. The Committee noted the extent of that quote and authorised officers to take direct action to remove the unauthorised six metre high pole and closed circuit television camera from the site.
