HINXTON: Planning Applications

29/10/2019 - S/4329/18/OL - Hinxton (Wellcome Genome Campus Hinxton Saffron Walden, Cambridgeshire, CB10 1RQ)

By eight votes to one, the Planning Committee endorsed approval of the Outline application subject to:

 

a)    Consultation with, and confirmation from, the Secretary of State that the application is not to be called in for his determination;

 

b)    The planning conditions set out in Appendix A to the report from the Joint Director of Planning and Economic Development and as set out on the Update report:

 

(i)            Condition 9 being amended

(ii)           Condition 51 being deleted

(iii)          Further consideration of conditions regarding sustainability and water and the emerging LP

 

and the final wording of any significant amendments to conditions being agreed by officers in consultation with the Chairman and Vice-Chairman prior to the issuing of the Decision Notice;

 

c)    The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 to include the Heads of Terms as set out in the report, and any other Heads of Terms or the detail including phasing and triggers, that are still under negotiation. The final wording of any significant amendments to the Heads of Terms listed in the report to be agreed in consultation with the Chairman and Vice- Chairman; and

 

d)    Delegated authority being given to officers to set out as part of the decision notice and in accordance with the Town and Country Planning (EIA) Regulations 2017, reg. 29 ‘information to accompany decisions’ a reasoned conclusion of the significant effects of the development on the environment and to carry out appropriate notification under reg. 30 accordingly.

By eight votes to one, with one abstention, the Planning Committee

 

1.    endorsed the range of policies applicable to the reasons for the refusal contained within the South Cambridgeshire Local Plan 2018 as set out in the Statement of Case;

 

2.    endorsed the decision to no longer pursue reason for refusal number 2 as part of the Inquiry proceedings;

 

3.    endorsed the officer interpretation of the missing text associated with reason for refusal number 6, namely between the words “…to allow the…” and “…therefore be contrary…” to add the words “…Local Highway Authority to fully assess the scheme and the proposal would…” so that Reason number 6 would then read as follows

 

Motorists would access the proposed development via the A1301 and a single access junction. The road network in this locality is already congested, as acknowledged in the submitted Transport Assessment (TA). A stage 1/2 Road Safety Audit has not been carried out on all the submitted drawings to allow the Local Highway Authority to fully assess the scheme and the proposal would therefore be contrary to: paragraphs 7, 17 and 32 of the National Planning Policy Framework 2012 and Policies DP/1, DP/3 (1b), DP/4 and TR/2 of the South Cambridgeshire Development Control Policies DPD 2007.

 

4.    to allow officers to pursue the submission of the Statement of Common Ground and proofs of evidence as required in accordance with Counsel’s advice; and

 

5.    to grant officers authority to agree to a set of planning conditions and planning obligations as part of the Inquiry proceedings.

 

((Councillors John Batchelor, Cahn, Fane, Heylings, Milnes, Topping. Heather Williams and Wright voted in favour. Councillor Rippeth voted against. Councillor Bradnam abstained.


08/08/2018 - S/1373/18/FL - Hinxton (Land adjacent Pettetts Barn, High Street)

Members visited the site on 10 July 2018.

 

Charmain Hawkins (applicant’s agent) addressed the meeting.

 

The ensuing Committee debate focussed on the location of the application site outside the village framework, and its likely impact on the countryside, Conservation Area and Listed Buildings in the High Street.

 

By eight votes to two, the Committee refused the application for the reasons set out in the report from the Joint Director for Planning and Economic Development.

 

Councillors Hawkins and Milnes voted to approve the application. Councillors John Batchelor, Cahn, Handley, Heylings, Rippeth, Roberts, Hazel Williams and Wright voted to refuse the application.


23/03/2018 - S/4099/17/OL - Hinxton (Land to the East of the A1301, South of the A505 near Hinxton and west of the A1301, North of the A505 near Whittlesford)

Members visited the site on 6 March 2018.

 

The Joint Director for Planning and Economic Development outlined the application and set it within the current planning policy context. The case officer updated the Committee about the application, highlighting that Ickleton Parish Council had objected to the application, primarily on landscape and transport grounds. Hinxton Parish Council supported the recommendation of refusal, but said that, should the Committee approve the application, the Legal Agreement under Section 106 of the Town and Country Planning Act 1990 should specifically address transport concerns.

 

 

Barbara Fagg (objector from Hinxton), Emma Fletcher (applicant’s agent), Councillor William Brown (Hinxton Parish Council), Councillor Aureole Wragg (Pampisford Parish Council), Councillor Andrew Greaves (Whittlesford Parish Council), Councillor Tony Orgee (local Member for Hnxton and Pampisford) and Councillor Peter Topping (Member for Whittlesford) addressed the meeting.

 

The Committee debate focussed on the prematurity of the application, not least because it had not been submitted as part of the process being followed as part of the emerging Local Plan. Noting the national and international significance of the proposal, the Committee was clear that the material planning interests of local people must take precedence.

 

The Principal Planning Policy Officer outlined the nature of Local Plan representations received.

 

Following further debate, the Committee gave officers delegated powers to refuse the application once the public consultation period had expired, for Reasons 2 to 8 inclusive, and Reason 10 set out in the report from the Joint Director for Planning and Economic Development (Reason 9 (Floods and Water) no longer being relevant) and Reason 1 set out in the said report Reason 1 amended to state 'The proposal represents an unsustainable form of development located outside of the village development framework and within the open countryside. The proposed site has not been allocated or put forward for development in the current Local Development Framework or emerging Local Plan. The development is therefore contrary to Policies DP/7 and ET/3 of the South Cambridgeshire Development Control Policies DPD 2007, Policy S7/8 of the Core Strategy DPD and Policies S/5, S/7, E/15 and E/16 of the draft South Cambridgeshire Local Plan 2014.

 

Councillor Deborah Roberts arrived at the meeting after the consideration of this application had started, and therefore abstained from voting.

Approval as amended by drawings date stamped 15thMarch and 21stJune 2007, and other minor variations to Units, in accordance with the recommendation to Committee on 6thDecember 2006, and subject to Conditions requiring windows in the northern elevation of Bedrooms 4 and 5 of Unit 2 to be permanently sealed and fully glazed with obscure glass, and the escape window in the western elevation of bedroom 4 to be fully glazed with obscure glass and hinged from the northern-most edge of the frame to minimise the overlooking of neighbouring properties.
