The Committee resolved to give officers delegated powers to approve the application subject to
1. no issues being raised during the additional consultation period;
2. referral of the application to the Secretary of State as a departure from the Development Plan;
3. the Conditions and Informatives set out in the report from the Joint Director of Planning and Economic Development, with an additional Condition requiring the submission of details as to the form, construction, and appearance of the flue, an additional Informative strongly encouraging ‘Green Excellence’ in terms of energy and other matters. but deletion of Condition ai(v) as this duplicated Condition y.

Had it still been in its gift to determine the application, and in order to assist officers in formulating the Council’s response to the appeal for non-determination, the Committee was minded to approve the application by six votes to five, subject to:
1. The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 in accordance with the Heads of Terms attached as Appendix 1 to the report from the Joint Director of Planning and Economic Development and update to public-art requirment as set out by the Planning Officer at the beginning of the meeting;
2. The Conditions and Informatives set out in the said report; and
3. Additional Conditions securing
a. Biodiversity net gain and survey identifying those existing trees on site to be retained
b. Consultation with local member and parish council on the Construction Environmental Management Plan sufficient to protect an affected vulnerable family
c. Additional information in traffic management plan condition to restrict hours of deliveries during peak school times and for a forman to ensure deliveries are carried out safly.
d. Permeability through the development

1. The adverse impact on the character, amenity, tranquillity and function of the Protected Village Amenity Area contrary to Policy CH/6 of the South Cambridgeshire Local Development Framework 2007 and Policy NH/11 of the Proposed Local Plan; and
2. The adverse impact on the spaciousness and open character of the area, and setting of the Grade II* Listed windmill.

The Committee refused the application contrary to the recommendation in the report from the Planning and New Communities Director. Members agreed the reasons for refusal as being the non-compliance with Policies DP/1 (Sustainable Development) and DP/2 (Design of New Development) contained in the South Cambridgeshire Local Development Framework 2007 and Policy E/8 (Mixed use development in the Histon and Impington station area) of the emerging South Cambridgeshire Local Plan 2013.
