By seven votes to two, the Planning Committee approved the application subject to the Conditions and Informatives set out in the report from the Joint Director of Planning and Economic Development.


16/07/2021 - 20/05253/FUL - Waterbeach (Cambridge Innovation Park, Denny End Road)

By seven votes to three, the Planning Committee approved the application subject to

 

1.    the prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 in accordance with the Heads of Terms referred to in the report from the Joint Director of Planning and Economic Development, subject to the parties exploring

 

a.    the viability of the shuttle buses being electric in accordance with the Committee’s aspiration; and

 

b.    together with Waterbeach Parish Council, the possibility of a scheme being brought forward by Urban & Civic that would secure street lighting and footpath improvements along the footpath to the north of Denny End Road as part of Phase 1A of the current application; and

 

2.    the Conditions set out in the report from the Joint Director of Planning and Economic Development with the final wording thereof being agreed by officers in consultation with the Committee Chair and Vice-Chair, including (but not limited to) rewording so as to require retention of the temporary car parking area until the decked car park is in use, and its retention should Phase 2 not proceed, and a landscaping Condition including details of fencing to the ponds; and

 

3.    the Informatives set out in the said report.

Upon the proposal of Councillor Anna Bradnam, seconded by Councillor Dr. Tumi Hawkins, and by affirmation, the Committee agreed additional wording in Condition 18 to secure ongoing management and maintenance of the piped ditch.

 

By six votes to five, the Planning Committee approved the application subject to the Conditions (as amended) set out in an agenda supplement from the Joint Director of Planning and Economic Development.

 

(Councillors Henry Batchelor, Cahn, Fane, Hawkins, Heylings and Rippeth voted to approve the application. Councillors Bradnam, Roberts, Heather Williams, Richard Williams and Wright voted to refuse it.)

The Planning Committee gave officers delegated authority to approve the application subject to

 

1.    The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 on the terms broadly referenced in Section 9 of the main report from the Joint Director of Planning and Economic Development, with delegated authority granted to the Joint Director of Planning and Economic Development to negotiate, secure, and complete such agreement on terms as are otherwise considered to be appropriate and necessary, including the Heads of Terms (HoTs) as set out in the report, and any other HOTs or the detail, such as phasing and triggers, that are still under negotiation. The final wording of any significant amendments to HoTs listed in the report will be agreed by officers in consultation with the Chair and Vice-Chair of Planning Committee prior to the issuing of planning permission;

 

2.    setting out, as part of the decision notice and in accordance with the Town and Country Planning (EIA) Regulations 2017 reg. 29 ‘information to accompany decisions’ a reasoned conclusion of the significant effects of the development on the environment and to carry out appropriate notification under reg. 30 accordingly;

 

3.    The presentation to Planning Committee in July or August 2021 of a report outlining progress with the Section 106 obligations; and

 

4.    The Conditions and Informatives set out in the report from the Joint Director of Planning and Economic Development amended as follows

 

(a)  Condition 15 now to state

 

No dwellings shall be occupied until the approved railway station (planning ref. S/0791/18/FL or as may be varied) has been completed and is open for use and the link road connecting the site to the southern junction with the A10 as shown on parameter plan 1330 GA 010002 Rev 17 in the adjacent U&C development site (planning ref. S/0559/17/OL) has also been completed and is open for use.

 

Reason: For the avoidance of doubt, to provide quality placemaking, and to ensure the delivery of strategic transport interventions before the occupation of any dwellings, and to ensure that the site is accessed in an appropriate and comprehensive manner, in accordance with Policy SS/6 of the South Cambridgeshire Local Plan 2018 and the Waterbeach New Town SPD.

 

(b)  Condition 42 now to state

 

No reserved matters applications shall be submitted, and no development shall commence until such time as a scheme to manage the residual risks of flooding from a River Cam flood embankment breach (scenarios to cover risks both within and outside of the site, to and from the development) has been submitted to and approved in writing by the local planning authority. The scheme shall be fully implemented and subsequently maintained, in accordance with the scheme’s timing/ phasing arrangements, or within any other period as may subsequently be agreed, in writing, by the local planning authority.

 

Reason: To manage flooding and to ensure that flood risk is not increased elsewhere by ensuring the satisfactory storage or conveyance of flood water diverted by the site during a breach of the River Cam Defences, in accordance with the National Planning Policy Framework and Policies SS/6, CC/8 and CC/9 of the South Cambridgeshire Local Plan 2018.

 

(c)  Condition 57 now to state

 

No development shall commence until a Site Wide Construction and Environmental Management Strategy (CEMS) has be submitted to and approved in writing by the Local Planning Authority. The document shall include details of:

 

…b) Indication of the locations of access routes and associated works to enable the carrying out of development including temporary haul routes, highway signage strategy and approach to monitoring and enforcement. These routes must exclude any existing residential roads.

By eight votes to two, with one abstention, the Planning Committee gave officers delegated authority to approve the outline application, as amended, subject to

 

a)    The Conditions set out in Appendix L to the report from the Joint Director of Planning and Economic Development (including Explanatory Notes and Terms)with conditions in relation to the foul water strategy to be consulted with the Environment Agency; consideration of an additional condition to address monitoring of visitor numbers exiting the site towards Wicken Fen and Cam Washes; and additional wording in the design code condition to include retention of the memorial garden. The final wording and / or any amendments of all the recommended conditions shall be agreed in consultation with the committee Chairman and Vice-Chairman prior to the issuing of planning permission;

 

b)    Contributions being secured by way of the prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 as set out in Appendices H (revised by way of an update report dated 9 May 2019) and I, the final terms being agreed in consultation with the committee Chairman and Vice-Chairman prior to the issuing of planning permission The Section 106 financial viability review mechanism shall include provisions to ensure that where there is an uplift in profit beyond 20% IRR this will be shared on a 50:50 basis between the developer and the Council. The Council will utilise its share towards delivery of on-site affordable housing and where this exceeds the 40% affordable housing Policy H/10 requirement the excess shall contribute towards the Section106 strategic transport improvements along  the A10 corridor; and

 

c)    The presentation to Planning Committee of a Summary / progress report on the Section 106 obligation after six months from 13 May 2019 if, by then, planning permission had not been granted.

By affirmation, the Committee deferred the application without debate to allow time for the applicant to amend the red line application boundary to include all areas of the access required to undertake the proposed development.

12/06/2020 - S/4383/19/DC - Waterbeach (Waterbeach Barracks, Denny End Road)

Councillor Deborah Roberts proposed that a decision be deferred until officers had considered the effect of the draft Waterbeach Neighbourhood Plan. This proposal was seconded by Councillor Heather Williams. The Delivery Manager (Strategic Sites) informed Members that the Neighbourhood Plan was still only a pre-submission document and, as such, could not be given any weight. Upon a vote being conducted by roll call, the proposal was defeated by seven votes to four. Councillors Ellington, Roberts, Heather Williams and Wright voted to defer, Councillors John Batchelor, Bradnam, Cahn, Fane, Heylings, Milnes and Rippeth voted against deferral.

 

Upon a vote being conducted by roll call, and by seven votes to nil with four abstentions, the Committee approved the amended Waterbeach New Town West Key Phase 1 Design Code. Councillors John Batchelor, Bradnam, Cahn, Fane, Heylings, Milnes and Rippeth voted to approve the Design Code. Councillors Ellington, Roberts, Heather Williams and Wright abstained.


14/09/2018 - S/0791/18/FL - Waterbeach (Land between Cody Road and Railway)

By seven votes to three, the Committee gave officers delegated authority to approve the application subject to

 

1.     The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 or, as an alternative, by virtue of a Unilateral Undertaking securing payment by the applicant of an index-linked sum of up to £50,000 as a contribution towards offsite highway works, including provision for traffic calming along Way Lane, Waterbeach , and improvements for pedestrians at the junction of Denny End Road and Bannold Road in Waterbeach;

 

2.     The Conditions and Informatives set out in the report from the Joint Director for Planning and Economic Development and Principal Planning Officer, any amendments and the final wording to be determined by officers after consultation with the Chairman and Vice-Chairman of the Planning Committee;

 

3.     An additional Condition as follows:

 

Highway Improvements

 

The railway station shall not be brought into use until traffic calming measures to enable safer pedestrian crossing of the road at the junction of Denny End Road and Bannold Road has been implemented in accordance with a scheme that will have been submitted to and agreed in writing with the Local Planning Authority.

 

Reason: To safeguard the amenities of nearby residents, in accordance with policy TR/3 of the South Cambridgeshire Local Development Framework Development Control Policies (Adopted July 2007) and policy TI/2 of the draft South Cambridgeshire Local Plan (2018)”; and

 

4.     The call-in and consideration of the application by the Secretary of State because of a third-party request to do so.

 

Councillors John Batchelor, Dr. Cahn, Fane, Handley, Heylings, Milnes and Rippeth voted to grant delegated approval. Councillors Topping, Heather Williams and Wright voted to refuse the application.


04/09/2018 - S/3865/17/FL - Waterbeach (Land at Cody Road & Capper Road)

Members visited the site on 16 August 2018 prior to the meeting.

 

Sophie Pain (applicant’s agent) and Peter Johnson (supporter) addressed the meeting.

 

Members focussed debate on concerns about noise from the convenience store, the routing of delivery vehicles, proximity of the development to the existing Nursery, and appropriateness of the arrangements for waste disposal. The Chairman expressed disappointment at the lack of affordable housing and regretted the absence of a viability review mechanism.

 

The Committee voted unanimously to give officers delegated authority to approve the application subject to:

                                                           

1.     The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 based on the Heads of Terms set out in Appendix 1 attached to the report from the Joint Director for Planning and Economic Development, such Legal Agreement  to  include wording as to the timing of the provision of the convenience store in relation to the occupation of the residential elements of the development (such wording to be agreed in consultation with the Chairman and Vice- Chairman of the Planning Committee );  ; and

 

2.     The Conditions set out in Appendix 2 to the said report, Condition 14 being reworded, in consultation with the Chairman and Vice-Chairman of the Planning Committee, to provide more effective control over noise resulting from the day-to-day operation of the convenience store and ensure compliance with the Delivery and Servicing Plan (July 2018). Officers undertook to explore options for limiting Permitted Development Rights to ensure compliance with the District Design Guide, specifically in relation to distances between the convenience store and the adjacent Nursery.

2.    the visual impact upon the open nature of land south of Bannold Road was unacceptable; and

3.    the development will result in the loss of land that could form a separation between the village of Waterbeach and the proposed new Settlement to the north.

This application did not appear on the agenda published on 25 February 2014. However, the Chairman agreed to accept it as a late item by reason of its urgency, namely that: -

 

  • Officers needed Members’ decision before 25 March 2014 because they needed to present the Council’s evidence in relation to a public inquiry by that date to clarify its position in relation to the visual impact of the development and was in the public interest. 

 

  • The next scheduled Planning Committee meeting was not until 2 April 2014, and a decision at that time would compromise the Council’s position in relation to any costs application.

 

  • It was not practical to convene a Special meeting of the Committee.

 

The Committee agreed to amend the putative reason for refusal (ii) be amended so as to read: -

 

“The development would result in the loss of a visually important open buffer, which presently separates Waterbeach and Waterbeach Barracks, to the harm of the setting of each. It would represent an undesirable coalescence of the village and Barracks. As such, the development is contrary to the adopted Local Development Framework 2007 at Policy DP/3, which seeks to prevent development that would have an unacceptable adverse impact on village character; and contrary to  Policy DP/7, which states that outside village frameworks only development for agriculture, horticulture, forestry, outdoor recreation and other uses which need to be located in the countryside will be permitted. The development would conflict with the aims of the policy, which is to seek the protection of the countryside from encroachment and to help guard against incremental growth in unsustainable locations.”

 

Such amendment should help to ensure that the appeal for non-determination is considered against the correct development plan policies and in respect of the correctly identified adverse impacts of the proposed development on this site.
