Purpose:

Release the Council’s charge on a small part of the ice rink site to allow the construction of a power station.

Decision:

To release the charge over that part of the ice rink land shown edged red and tinted pink on the attached plan.

 

Reasons for the decision:

To provide power for the ice rink, it is necessary to construct a small power station. The energy supplier will not construct the power station unless they own the freehold of the land it is on. The freehold is held by Marshalls and they want to transfer the land to Eclipse Power Networks. For this to happen CLIC need to surrender part of their leasehold, and as this part is charged to SCDC, the Council will need to agree to release that part of the land from the legal charge. 

 

Alternative options considered:

The Council could release the charge on the entire site, but this would weaken the Council’s position in any future negotiations and a release of the entire site has not been requested.

The Council could refuse to release the charge on the area requested but this would prevent the construction of the power station and consequently prevent the ice rink from becoming operational.
