Decision:

By affirmation, the Committee agreed

 

1.    That, as Order Making Authority, South Cambridgeshire District Council should approve the proposed diversion of Public Footpath No. 5 in Wimpole as meeting the legislative tests set out in Section 257 of the Town and Country Planning Act 1990; and

 

2.    That Cambridgeshire County Council be directed to make an appropriate Order as agents for South Cambridgeshire District Council.

Minutes:

The Committee considered a report from Cambridgeshire County Council’s Asset Information Definitive Map Manager about the proposed diversion of Public Footpath number 5 in Wimpole.

 

There had not been any objections raised.

 

By affirmation, the Committee agreed

By ten votes to one, the Committee gave officers delegated powers to approve the application subject to

 

1.     The applicant giving a Unilateral Undertaking to fund a Traffic Regulation Order consultation exercise, carried out by the Local Highways Authority, to establish whether the residents of Arrington wanted parking restrictions introduced in the village, paid for by the applicant up to an agreed limit;

 

2.     The Conditions set out in the report from the Joint Director for Planning and Economic Development; and

 

3.     An additional Condition addressing the issue of a programme of cycle speed restriction measures.

 

Councillors John Batchelor, Dr. Carn, Fane, Handley, Heylings, Milnes, Rippeth, Roberts, Topping and Wright voted to approve the application. Councillor Heather Williams voted to refuse it.

Minutes:

Members visited the site on 9 October 2018.

 

Clive Porter (objector), David Hassall (applicant’s agent) and Alex Devon (agent for Arrington Parish Council) addressed the meeting.

 

Members highlighted the following as matters of concern:

 

·        Specification of the proposed trail

·        The ongoing ‘no charge’ status of the car park

·        Safety considerations with a multi-use facility

·        Desirability of a Ranger service

·        The impact on Arrington

·        Ecology

The Committee gave officers delegated powers to approve the application, subject to outstanding consultation responses relating to the amended plans, and safeguarding Conditions.

 

Councillor SGM Kindersley declared a personal interest as Cambridgeshire County Councillor for the Electoral Division of Gamlingay, covering the parish of Wimpole.  He had attended meetings at which this application had been discussed.

Decision:

Delegated approval as report subject also to the developer agreeing to provide more garden land for each dwelling.  If agreement cannot be reached on the provision of additional garden land, the application will be referred back to Committee for determination. 

Minutes:

Prior to considering this application, the Committee attended a site visit on 6 August 2008.  The Committee gave officers DELEGATED POWERS TO APPROVE the application, subject to the Housing and Development Manager supporting the scheme, the resolution of issues relating to access, parking, drainage, ecology and landscaping, safeguarding Conditions, and to the developer agreeing to provide more garden land for each dwelling.  If agreement could not be reached on the provision of additional garden land, the application would be referred back to the Planning Committee for determination.

Councillor RF Bryant was present at the meeting at which Wimpole Parish Council had considered this application, but did not speak and was now considering the matter afresh.

Minded to approve contrary to report,  on the grounds that part of the site is brownfield with a Certificate of Lawful Existing Use or Development, and the proposal would lead to ecological gain.  The proposal would be referred to the Secretary of State as a Departure from the Development Plan.

Minutes:

The Committee was MINDED TO APPROVE the application, contrary to the recommendation contained in the report from the Director of Development Services, on the grounds that part of the site was a brownfield site with a Certificate of Lawful Existing Use or Development, that the proposal would lead to ecological gain, and that it would secure a contribution towards affordable housing, subject to the proposal being referred to the Secretary of State and not being called in by him for determination.

 

Councillor SGM Kindersley informed the Committee that he had been present, as the local County Councillor, when Wimpole Parish Council had considered this application.  He was considering it afresh.

 

Councillor Dr DR Bard abstained from voting as he had not attended the site visit.
