Approval as report 

APPROVAL, as amended by plan reference BW-04/d, for the reasons set out in the report from the Director of Development Services and subject to the Conditions referred to therein and an additional Condition requiring temporary off-street parking during the construction period.  In Condition 12, the word “further” would be inserted between the words “No” and “windows” in the first line. 

Councillor R Hall declared a personal interest when this item was considered on 1st December 2004 (Item 22 refers) by virtue of his acquaintance with the occupier of no. 4 Butler Way.  He was not present during the current debate.

Councillor CR Nightingale declared a personal interest by virtue of his acquaintance with the occupier of no. 2 Butler Way, and did not vote.

Delegated Refusal as report, subject to consultation with local Members and the Chairman of the Development and Conservation Control Committee

DELEGATED REFUSAL, in consultation with local Members and the Committee Chairman, should the applicant company fail to complete a Section 106 Legal Agreement, or one which provides an acceptable mechanism for the provision of 30% affordable houses which meets agreed housing needs, as it would be contrary to Policies CNF1 and HG7 of the South Cambridgeshire Local Plan 2004.

Delegated approval as report, with the Section 106 Agreement to include NIAB as a party and to require a commuted sum relating to maintenance of Awarded Watercourse 164, and an element of affordable housing.   Conditions to include those relating to working hours, and surface water drainage, and limiting deliveries to being on-site.

Withdrawn from the agenda 

This item was WITHDRAWN from the agenda.  Linton Parish Council had withdrawn its objections, and the application could thus be determined under delegated powers.

Delegated approval as report, subject to the Land Drainage Advisory Group agreeing to the terms of the Section 106 Agreement. 

DELEGATED APPROVAL, for the reasons set out in the report from the Director of Development Services, subject to the prior completion of a Section 106 Legal Agreement securing the payment of a commuted sum (the extent of which to be determined by the Land Drainage Advisory Group) to the Council to cover the increased maintenance costs along the award drain as a result of the proposed development, and to the Conditions referred to in the report presented to the Committee on 3rd November 2004 (Item 45 refers).

Refused as report with additional reasons being design, and loss of the day centre

REFUSED for the reasons set out in the report from the Director of Development Services and two additional reasons relating to design and the loss of the Day Centre, the latter of which would contravene Policy CS9 of the South Cambridgeshire Local Plan 2004.

Delegated approval, contrary to report.  Conditions (reinforced by a Section 106 Agreement) to restrict occupation to the applicant only and require removal of the Mobile Home if no longer required.  Reason: special circumstances of applicant. 

DELEGATED APPROVAL, contrary to the recommendation contained in the report from the Director of Development Services, subject to the prior completion of a Section 106 Legal Agreement reinforcing Planning Conditions restricting occupation to the applicant only and requiring removal of the Mobile Home if no longer required.  Members considered that such a Decision was justified in view of the applicant’s personal circumstances.

The Committee was MINDED TO APPROVE the application, for the reasons set out in the report from the Director of Development Services, subject to it being referred to the Secretary of State under the provisions of the Town and Country Planning (Residential Development on Greenfield Land) Direction 2000 and not being called in by him for determination, to the prior completion of a Section 106 Legal Agreement relating to financial contributions towards the provision of affordable housing, community gain, maintenance of public open space, footpath improvements and education contribution, and subject also to the Conditions referred to in the report.

Councillor Mrs SA Hatton declared a personal interest as a member of Planning For Sawston.

Approval contrary to report.  Reasons: proportionate to dwelling and does not adversely affect the Green Belt. 

APPROVAL contrary to the recommendation contained in the report from the Director of Development Services.  Members considered the proposal to be modest, proportionate to the scale of the existing dwelling, and that it would not adversely affect the Green Belt.  Accordingly, it would not offend the aims of Policy GB2 of the South Cambridgeshire Local Plan 2004.  While the application would have to be advertised as a departure from the Development Plan, officers did not consider it necessary to refer it to the Secretary of State.

Councillor Dr J Williamson informed the Committee that she had observed both the meetings of Landbeach- and Waterbeach Parish Councils, but had contributed to neither.

Delegated approval as report and resolution of surface water drainage issue 

DELEGATED APPROVAL, as amended by plans date stamped 20^th October and 29^th November 2004, for the reasons set out in the report from the Director of Development Services, subject to (1) no objections being received from the Environment Agency, Anglian Water or Over and Willingham Internal Drainage Board (2) suitably amended plans taking account of requirements for refuse vehicle access and comments from the Conservation Manager, and (3) the prior completion of a Section 106 Legal Agreement securing the provision of affordable housing, contributions towards education, the provision of a village hall and,  in lieu of provision of outside play areas, the extension of the recreation ground and provision and maintenance of facilities upon it, public open space and its maintenance, and public arts, and subject also to the Conditions referred to in  the report.  Officers also undertook to resolve the issue of surface water drainage into the Council’s Awarded watercourse prior to the issue of a Decision Notice.

DELEGATED APPROVAL, as amended by drawing nos. A.24.397b, 01-54-100E, 01-54-101B, 01-54-102F, 01-54-111D, 01-54-112C, 01-54-201A, 01-54-104F, 01-54-200A and 01-54-202, certificate date stamped 9^th November 2004, and facsimile message dated 11^th November 2004, for the reasons set out in the report from the Director of Development Services and subject to the Conditions referred to therein, the Local Highways Authority’s request for vehicle passing places being clarified and considered by officers in consultation with the Local Member, the payment of a commuted sum or the provision of land for affordable housing, consideration being given to revising the windows in the dwelling on plot 2 to reduce overlooking of properties in Mill Lane and consideration being given to using the land between the site and dwellings in High Street as a wildlife park.  Officers also undertook to issue an Informative requiring that construction vehicles access the site via the High Street. 

Councillor Mrs DP Roberts did not vote.

Delegated approval contrary to report, subject to resolution of design and archaeology issues.  Reasons: sustainability, local need, opportunity to secure removal of pallets on site, and  

DELEGATED APPROVAL contrary to the recommendation contained in the report from the Director of Development Services, subject to resolution of design, archaeology and landscaping issues and the removal of the pallet store currently on the site. Having visited the site, Members recognised the interests of sustainable tourism, the ability of landscaping to overcome the visual harm of the development, that the development would meet an unmet need for accommodation for coach parties and car based business people, that the development would compliment the adjacent travel lodge and the opportunity to secure removal of the pallet store currently on site.

Councillor J Williams declared a prejudicial interest by virtue of owning a Bed-and-Breakfast business in Ickleton that could be adversely affected by this development, and withdrew from the Chamber.

Delegated approval subject to a Section 106 Agreement linking the dwelling to Mill Barn 

DELEGATED APPROVAL, contrary to the recommendation contained in the report from the Director of Development Services, subject to improvements to the design of the proposal along the lines of the Conservation Manager’s comments and the variation of the Section 106 Legal Agreement that currently links the adjacent annexe to Mill Farm House so as to link it to the approved dwelling.  Members considered that the building was worthy of preservation and the proposal involved an appropriate re-use of the building in terms of Planning Policy Statement 7 (Sustainable Development in Rural Areas) and Policy GB2 of the South Cambridgeshire Local Plan 2004.

REFUSED, on the Chairman’s casting vote, contrary to the recommendation contained in the report from the Director of Development Services.  Having visited the site, Members considered that vehicle access would create problems and that the proposal would harm the rural character of the village contrary to Policies P1/3, P5/5 and P7/6 of the Cambridgeshire and Peterborough Structure Plan 2003 and Policies SE5, SE9, EN28 and EN30 of the South Cambridgeshire Local Plan 2004.
