Adoption of s27 Policing and Crime Act 2009 pdf icon PDF 127 KB

Decision:

The Licensing Committee RECOMMENDS to the Leader of the Council, the adoption of Schedule 3 of the Local Government (Miscellaneous provisions) Act 1982 as amended by s27 of the Policing and Crime Act 2009 to apply in the district of South Cambridgeshire.

 

Other Options Considered: The adoption of s27 is optional, however, if the amendment within the Policing and Crime Act 2009 is not adopted by 6 April 2011, then any future adoption would be subject to a consultation process.

 

Reason for Decision: To commence with the adoption prior to the 6 April 2011 deadline as defined in the Policing and Crime Act 2009.

Minutes:

The Licensing Officer explained to Members that on 6 April 2010 the s27 Policing and Crime Act 2009 relating to sexual entertainment venues came into effect and although it was not mandatory for local authorities to adopt, it would however, require a consultation process if adoption subsequently occurred after 6 April 2011.

 

The provisions of the Act introduce a new category of sex establishment called a sexual entertainment venue into the existing legislation. The venues are defined to include live performances or a live display of nudity. Adoption of s.27 enabled the Council to regulate such venues.

 

The Licensing Committee, having taken a vote, RECOMMENDS to the Leader of the Council on 11 November 2010 and subsequently to full council on 25 November 2011, the adoption of Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982 as amended by s27 of the Policing and Crime Act 2009 to apply in the district of South Cambridgeshire.

 

Councillor Nigel Cathcart abstained from voting.

The Licensing Committee APPROVED the draft Sex Establishment Licensing Policy in order to commence a consultation process. 

 

Other Options Considered: Not to progress with the Policy or make amendments to the draft Policy prior to consultation.

 

Reason for Decision: To enable the Council to be transparent in its decision making procress.

Minutes:

The Licensing Officer sought the approval of the draft Sex Establishment Licensing Policy for Sex Establishments licensed under Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982 incorporating amendments made under s27 of the Policing and Crime Act 2009 in order to proceed with a consultation process.

 

The Licensing Committee considered the draft Sex Establishments Policy included in the agenda papers and as a result of the ensuing discussion made the following changes:

 

·         Para 2.2                Include `Premises where private entertainment booths are

provided’ in the list containing the forms of entertainment

·         Para 3.3                Re-word the first bullet point to read Book shops sales of

sexual material

·         Para 3.3                re-word the second bullet point to read Sexual Health Clinics

·         Para 5                   First sentence to read … rural area comprising 103 parishes,

in which…

·         Para 5.3                Second sentence be re-worded: In general the authority would

discourage applications for areas it considers to be

inappropriate, having regard to the character of the relevant locality

·         Para 5.9                Add the words `including the impact on the local

amenity’  to the end of the first sentence

·         Para 7                   Add Equality and Diversity Officer and on the advice of the

Equality and Diversity Officer, also add appropriate men’s groups to the list of consultees

·         Page 16/17/19            paras 4, 9 and 22. Amend the grammar from he/his to he/she

or their

·         Page 17                para 11. Substitute expect for except

·         Page 18                para 19. Last sentence to read: People over the age of 18 but

under the age of 21 will be required to show proof of their age

 

The Licensing Committee also removed Faith Groups from the list of consultees.

 

The Licensing Committee APPROVED the draft Sex Establishment Licensing Policy, subject to the above amendments, in order to commence a consultation process.

The Licensing Committee APPROVED the draft Street Trading Licensing Policy in order to commence a consultation process.

Reason for Decision: To enable the Council to be transparent in its decision making process.

Minutes:

The Licensing Officer informed Members that the Council had no clear guidance on Street Trading in the district and was therefore requesting approval from the Licensing Committee to commence a consultation process on the draft Street Trading Policy as detailed in the agenda papers.

 

As a result of consideration of the draft policy, the Licensing Committee requested the following amendments:

 

Para 4.1                      An additional bullet point entitled Markets and Fairs operating under separate authorisations

Page 10(b)                  Bold/Capitalise the word unless

Page 11                       Substitute Licesning with Licensing

 

The Licensing Committee APPROVED, subject to the above amendments, the draft Street Trading Licensing Policy in order to commence a consultation process.
