To elect a Chairman of the Licensing Committee (2003 Act) for the municipal year 2008/09. 

Councillors RE Barrett and Mrs CAED Murfitt were nominated and seconded and, following a show of hands of those Committee members present, it was

RESOLVED    that Councillor RE Barrett be elected Chairman of the Licensing (2003 Act) Committee for the municipal year 2008/09. 

To appoint a Vice-Chairman of the Licensing Committee (2003 Act) for the municipal year 2008/09. 

Councillors R Hall and Mrs CAED Murfitt were nominated and seconded and, following a show of hands of those Committee members present, it was

RESOLVED    that Councillor R Hall be appointed Vice-Chairman of the Licensing (2003 Act) Committee for the municipal year 2008/09.

To confirm the minutes of the meeting held on 15 November 2007.

The Committee authorised the Chairman to sign, as a correct record, the Minutes of the meeting held on 15 November 2007. 

Members are recommended to,

(a)               appoint 6 Members to act as Chairmen of the individual sub-committees required in respect of future hearings under the Licensing Act 2003 and Gambling Act 2005 regulations, and

(b)               once the Chairmen have been appointed, delegated authority be given to the Chairman of the Licensing Committee and Corporate Manager, Health and Environmental Services to approve the combinations of Chairmen and Members for each panel and those combinations be appended to the minutes of this meeting.

Prior to consideration of this item, the Licensing Committee

AGREED that the Chairman and Vice-Chairman of the Licensing (2003 Act) Committee would be eligible to chair panel hearings under the Licensing (2003 Act) and Gambling Act 2005.

It was recommended by Councillor A Riley, seconded by Councillor Mrs CAED Murfitt, that the Chairmen of the Panels for the municipal year 2007/08 be re-appointed for the municipal year 2008/09. There was, however, a vacancy owing to the resignation from the Council of one of the previous Chairmen. Councillors RE Barrett, Mrs JM Guest and RM Matthews expressed an interest in becoming a chairman of the panels. Councillors RE Barrett and Mrs JM Guest were proposed and seconded; Councillor RM Matthews was proposed, but not seconded. On taking a vote, it was agreed that Councillor Mrs JM Guest replace the retired Member.

The Licensing (2003 Act) Committee then unanimously

(a)            AGREED that the following Members be appointed Chairman of the Sub-Committee required in respect of future Hearings under the Licensing (2003 Act):

Councillor Mrs PM Bear

Councillor Mrs JM Guest

Councillor R Hall

Councillor R Martlew

Councillor Mrs CAED Murfitt

Councillor A Riley

(b)            AGREED that the following Members be appointed Chairmen of the Sub-Committee required in respect of future Hearings under the Gambling Act 2005:

Councillor RE Barrett

Councillor Mrs PM Bear

Councillor Mrs JM Guest

Councillor R Hall

Councillor R Martlew

Councillor Mrs CAED Murfitt

(c)               gave DELEGATED APPROVAL to the Chairman of the Licensing Committee (2003 Act) and the Corporate Manager, Health and Environmental Services to approve the combinations of Chairmen and remaining Members for each Sub-Committee; the combinations to be appended to the minutes of this meeting.

In order to participate in Hearings under the Licensing (2003 Act) and Gambling Act 2005, all Members of the Licensing (2003 Act) Committee must have completed the relevant training.

The Committee is requested to note the attached statistical information relating to 2003 Act and Taxi hearings.

The Licensing (2003 Act) Committee NOTED the statistical information relating to Taxi hearings and hearings undertaken in accordance with the Licensing 2003 Act during the municipal year 2007/08.
