Declarations of Interest

Minutes:

Cllr Mark Howell and Cllr Jose Hales declared a non-pecuniary interest as they knew Tony Orgee as a former District Councillor at South Cambridgeshire District Council.

The Chair of the Sub-Committee will welcome those present and introduce him/herself; the remaining members of the Sub-Committee and the officers will then introduce themselves.

 

A copy of the Sub-Committee appeals procedure will be attached later.

The application

To consider the application for street trader consent.

Background

On 17 April 2023, an application for a static street trader consent was submitted to trade Tuesday to Saturday between 16:00 and 23:00 every week at Abington Social Club, Pampisford Road, Great Abington, CB21 6AH.

 

A previous application was submitted to trade in Bar Hill, this was refused in February 2023, and not progressed further.

 

In line with the Council’s current Street Trading Policy, views were sought on the application by consulting with:

 

       Ward & Division Councillors

       Parish or Town Councils

       South Cambridge Council Environmental Health

       Cambridgeshire Constabulary

       Shared Planning Service

       Cambridgeshire County Council Highways

 

Where valid representations have been received against an application, the application will be referred to the Licensing Sub-Committee for determination. There is no formal right of appeal against refusal of an application following the decision.

 

The application has been opposed by a local business and Great Abington Parish Council.

Observations:

The panel heard representations from the applicant, the applicant’s representative and the objector who explained the details and key points of the application. The following was explained:

 

·       Mr Teksin had been trading for three weeks after applying to SCDC before being informed that he must stop until a licence had been obtained.

·       Mr Teksin addressed the objections in the report including issues regarding the signage for the business.

·       Mr Teksin outlined that during his short time trading at the venue, there had been no issues and that he had not had many customers.

·       It was confirmed that no objections had been received other than from Abbington Parish Council and ARCC.

·       It was explained that the Kebab Wrap would open 4:00pm so that any parking issues could be avoided as the Social Club would not yet be open at that time.

·       It was explained that an issue highlighted with black bin bags was as a result of the Social Club not having a commercial bin and that this issue had since been resolved.

·       It was remarked that the Parish Council did not object in principle to the application but wanted the street trading licence to operate for fewer hours and on fewer days than what had been applied for.

·       It was outlined that the main concerns of the Parish Council were road safety and the impact on residents.
