Appeal against the refusal to grant a Private Hire Driver licence

Minutes:

The sub-committee heard representations from the appellant and Licensing Officer, based on the written report.

The Sub-Committee panel decided on the balance of probabilities to revoke the Private Hire Driver Licence.

Reasons:

In making its decision the sub-committee considered the following:

·       Statutory provisions: S51,61 & 77 Local Government (Miscellaneous Provisions Act) 1976

·       Statutory taxi and private hire vehicle standards issued by the Department of Transport in July 2020

·       South Cambridgeshire District Council Private Hire and Taxi Policy · Report of the Licensing Officer

·       Advice from the Council’s legal adviser

·       Evidence as referred to above.

The sub-committee made its decision for the following reasons:

  • The appellant had an offence for violence in 2016, which would not expire until 2026 in line with the South Cambridgeshire District Council Policy.
  • The panel was concerned the appellant had failed to comply with multiple previous orders from public bodies and were unsure he would comply with the Council’s orders.
  • The appellant had incurred too many offences previously for the panel to be sure he was a Fit and Proper Person on the balance of probabilities.
  • The panel was concerned that the appellant had not been truthful with regards to the knife that had been found on his bicycle upon arrest.
  • The appellant had also incurred a recent offence for speeding.
