The Panel has considered the application very carefully and had due regard to the Licensing Act 2003, the accompanying Guidance and Regulations and the SCDC Licensing Policy.
The Panel heard the evidence of the applicant and twoof the representees present at the hearing and have noted the concerns of local residents regarding residential amenity and feel these are addressed by the conditions listed below.
General traffic problems beyond the Premises are out of our jurisdiction and a matter for the local highway authority, however, the panel did have regard to representations made concerning the adequacy of the access and exit arrangements but considered that where these served the pre-existing use of the premises, there was no justification for any conditions to be imposed.
The Sub-Committee APPROVED the application with modifications as stated in the operating schedule, together with the following conditions:
(a) Prominent, clear and legible notices shall be displayed at the exit, in lavatories and in the car park requesting patrons to respect the needs of local residents and to leave the premises and the area quickly and quietly.
(b) Alcohol supplied shall not be consumed outside the premises
(c) Doors and windows shall be kept closed when there is any regulated entertainment taking place, except to allow access to and egress from the premises
(d) The placing of bottles into receptacles outside the premises shall only take place between 10:00 and 20:00 hours.
(e) No amplified music shall accompany Live Music or Performances of Dance.
(f) All events involving the supply of alcohol shall be notified in advance to the originators of the representations considered in connection with this application for so long as they remain resident at the same addresses.
Interested parties and responsible authorities may apply for a review of the licence on a ground relating to one or more of the licensing objectives should there be any relevant issues arising from the operation of the premises licence at any stage in the future. The four licensing objectives are: the Prevention of Crime and Disorder; Prevention of Public Nuisance; Public Safety and Protection of Children from Harm.
The applicant and objectors have a right of appeal to the Cambridge Magistrates’ Court within 21 days of receiving notification of this decision.
