BACKGROUND

 

On 28 May 2012, a Closure Order under s. 165 of the Licensing Act 2003 was made by the Cambridge Magistrates Court.

 

On 30 May 2012, the Licensing (2003 Act) Sub-Committee:

a)    Confirmed the Closure Order and directed that it remained in force until midnight on 27 June 2012 unless removed or varied at a Full Review by this committee and,

b)    Suspended the premises licence until midnight on 27 June 2012 unless removed or varied by this sub-committee.

(Reasons (a) & (b): For the prevention of crime and disorder and prevention of public nuisance)

 

FULL REVIEW HEARING

 

At the start of the hearing the Sub-Committee was informed by Mr Phillips that the Police and Mr Forster’s representative had reached an agreement about their desired outcome from the hearing, which was for the removal of Mr Forster as DPS and a suspension for three months of the premises licence. In addition to the written representations included in the Report pack, the Sub-Committee heard representations from the following:

Mr Snelling Counsel for Mr Forster

Mr Forster (Tenant and Designated Premises Supervisor)

 

It was DECIDED

  1. That Graeme Forster be removed forthwith as Designated Premises Supervisor.
  2. That the premises licence should be suspended for three months with immediate effect. (REASON – to promote the licensing objectives of Prevention of Crime and Prevention of Public Nuisance)
