In consideration of the Applicant’s undertaking to immediately implement and maintain in force and effect the measures in paragraphs numbered 1 – 7 inclusive of the representation made by the Council’s Environmental Health Officer date stamped 6 September 2012, and upon the Applicant expressly amending the application at the hearing so as to exclude any outside performance/playing of live or recorded music, the Sub-Committee has considered the application.

Due regard has been given to the Licensing Act 2003, accompanying Guidance and Regulations, SCDC Licensing Policy, and to written and verbal representations received from the Applicant, Responsible Authorities comprising the Police and the Council’s Environmental Health Officer, and from members of the public who had submitted Relevant Representations.

On the basis of these considerations, and in furtherance of the licensing objective of preventing public nuisance, the Sub-Committee decided to GRANT the application to vary the Club Premises Certificate to permit the activities for the related hours as are outlined in the table above, subject to the condition below:

 

1.         No alcohol supplied under the scope of the Club Premises Certificate shall be consumed other than within the confines of that part of the premises interior, as is more particularly denoted and annotated ‘consumption of alcohol’ upon the floor plan dated 21 July 2005 as is incorporated within the Operating Schedule to the Certificate.    

 

Local residents may apply for a review of the Certificate on a ground relating to one or more of the licensing objectives should there be any relevant issues arising from the operation of the varied Club Premises Certificate at any stage after the date of this decision notice.  The Sub-Committee hope that local residents will feel able to bring any future concerns directly to the attention of the Applicant in an effort to reach an amicable solution to any future problems.  The four licensing objectives are: the Prevention of Crime and Disorder; Prevention of Public Nuisance; Public Safety; and Protection of Children from Harm.

 

The applicant and objectors have a right of appeal to the Cambridge Magistrates’ Court within 21 days of receiving notification of this decision.
