The application

 

 

The application to grant a Premises Licence for Mo Malik’s, Unit 2/3 Orchard House, Unwin Square, Cambridge, CB4 2AD was received by the licensing department and sent out for consultation on the 6 May 2020.

 

The application was accompanied by:

·       The required fee

·       An operating schedule (included in the application form)

·       A plan of the premises

·       A consent form from the person specified as the designated premises supervisor (DPS)

·       The DPS entitlement to work in the UK.

 

The requirements for advertising and displaying relevant notices were carried out in accordance with the Licensing Act 2003.

 

The application is for the grant of a new Premises Licence.

 

The requested days and times for opening and the sale of alcohol for consumption both off and on the premises applied for are as follows:

 

MONDAY-SUNDAY

 

Opening Hours:

12:00 to 23:30

Supply of Alcohol

12:00 to 23:30 (on and off the premises)

         

Background

 

The premises can be found on Unwin Square, which is a mixture of residential houses and local shops. 

 

As required by the Licensing Act policy, the application was sent to all responsible authorities for consultation as part of the licensing application process.

 

Notification of the application was sent to 53 neighbouring properties. A photograph of the Blue Notice correctly displayed was received. The Notice was advertised in the Cambridge Evening News on the 12 May 2020.

 

As part of the application process the applicant was made aware of the representations.

Relevant representations 

 

No representations were received from the responsible authorities however representations were made by interested parties:

 

·       On 27 May 2020 a representation was received from an interested party. This representation was later withdrawn after further clarification of the operating schedule.

 

·       On 2 June 2020 a representation was received by an interested party, relating to the prevention of public nuisance and crime and disorder objectives. This was taken into account by the sub-committee.

 

 

Observations:

 

The panel heard representations from the applicant and his legal representative. Mr Miah’s legal representative explained that pre-consultation had taken place with the Police and several conditions had been agreed to safeguard against any concerns. The nature of the business was explained. Mr Miah explained that he wanted the business to be an asset to the community of which he was a member. The focus of the business was the dining experience and alcohol was ancillary to this.

 

Mr Miah had 20 years’ experience in this sector.

 

The panel also considered the applicant’s Statement of Operation which explained how the four licensing objectives would be met.

 

 

The decision

 

The Sub-Committee was satisfied with the answers provided to their questions by Mr Miah.

 

Taking all the above into account and the evidence provided in the application and by the applicant during the hearing, the Sub-Committee agreed the application for the grant of a Premises Licence for the Sale of Alcohol for consumption on and off the premises for the following days and times for opening:

The objector has a right of appeal to the Cambridge Magistrates’ Court within 21 days of receiving notification of this decision.
