The application for a Premises Licence for O&T Wines Limited was received on 7 July 2020. The requirements for advertising and displaying relevant notices were carried out in accordance with the Licensing Act 2003.
The application is for the grant of a new Premises Licence for sale of alcohol for consumption off the premises. The requested days and times for Sale of Alcohol for consumption off the premises are as follows:
Monday 9:00 to 18:00
Tuesday 9:00 to 18:00
Wednesday 9:00 to 18:00
Thursday 9:00 to 18:00
Friday 9:00 to 18:00
All panel members declared that they knew the applicant’s father, Councillor Neil Gough, however none knew the applicant. Councillor Peter McDonald also declared that he had discussed the general concept of the business with Councillor Gough, but had not discussed any detail of this or the application with either Councillor Gough or the applicant.
This application was being put to the Licensing Appeals Sub-Committee for determination due to the relationship between the applicant and a Member of the Council; the applicant is the son of Councillor Neil Gough.
All applications which are submitted by, or on behalf of, a member of the Council in their private capacity or by a close friend, relative or the partner of a member (as defined in the Code of Conduct for Members) shall be reported to the committee for a decision, rather than being dealt with in accordance with the Scheme of Delegation to Officers.
The premises are located at Unit B, Broad Lane Industrial Estate in Cottenham and is within the premises of N&M Wholesalers who have a current premises licence for the whole building. The application is for Room 3 only within that premises.
A photograph of the Blue Notice correctly displayed was received. The Notice was advertised in the Cambridge Evening News on 16 July 2020.
Right to work checks were made on the applicant as part of the application and were approved.
As required by the Licensing Act policy, the application was sent to all responsible authorities for consultation as part of the licensing application process.
A representation was received as part of this process from Environmental Health to add conditions and amend the opening hours. These were accepted by the applicant and therefore Environmental Health has no objection for the granting of the licence on this basis.
Emails were also received form Cambridgeshire Fire and Rescue Service and Trading Standards declaring that they had no objections to the application, although a fire risk assessment would be required.
The panel heard representations from the applicant who explained the nature of the business, how the premises would be used and how daily operations would work at the premises which would be used for the sale and distribution of alcohol. The applicant explained that no consumers would visit the premises. He explained the measures that were in place to ensure the protection of children, to ensure alcohol did not get into the possession of a minor. The applicant explained the measures that would be put in place for incoming and outgoing deliveries to avoid creating traffic on Broad Lane.
Taking all the above into account the Sub-Committee agreed to grant the Premises Licence subject to the incorporation of the conditions that had been proposed by Environmental Health and to which the applicant had confirmed he agreed.
The applicant has a right of appeal to the Cambridge Magistrates’ Court within 21 days of receiving notification of this decision.
