The Planning Sub-Committee deferred consideration of the enforcement issues involved at Moor Drove, Histon pending determination of the retrospective planning application. 


02/12/2008 - Plot 4, Moor Drove, Histon - Temporary Stop Notice (unauthorised building) (verbal update)

The Planning Sub-Committee authorised officers to investigate injunctive action in this case alongside those enforcement measures available to them by virtue of delegated powers.

The Chairman agreed to take this as a late urgent item.

 

The Sub-Committee

 

AGREED        that no action to deal with the breach of Enforcement Notice 19/03 be taken before 15 September 2006 and that no decision be made on the form of action to be taken until further legal advice has been received.


07/07/2006 - Moor Drove, Histon

Agreed unanimously

  • paragraph 46, which stated that the “ application was “similar” to the application rejected on appeal last year.”
  • paragraph 47, which stated that “there has been no change in the physical circumstances of the site, nor in the nature of the development, with the result that none of the previous objections has diminished in force.”
  • that the new guidance did not alter the weight of any planning consideration of importance in the decision taken by the Council to refuse planning permission and the Secretary of State to reject the subsequent appeal.
  • That the present application sought to put pressure on the Council in the manner suggested in paragraph 5 of Annex 2 of C14/91.
  • that this was not a “doubtful” case and there were good reasons not to determine the application.
