By ten votes to nil with one abstention, the Committee resolved to give officers delegated approval to refuse the application for the reasons set out in the report from the Joint Director of Planning and Economic Development, subject to no issues being raised during the additional consultation period.

05/05/2016 - S/3182/15/FL - Harston, (57 London Road)

Mr Brunwin (objector), Josh Palmer (applicant’s agent) and Councillor Janet Lockwood (local Member) meeting. Mr Brunwin said that the proposed new dwelling on Plot 2 would be overbearing and would adversely affect his greenhouse and trees by blocking natural light. He said that amenity would further be affected by virtue of part of his property being overlooked by the new dwelling on Plot 2. Mr Palmer said that the proposed development had sought to have a positive impact through careful discussion with planning and urban design officers. Councillor Lockwood said that the proposed development was out of keeping with much of Harston, and would have an adverse impact on Mr Brunwin’s amenity.

 

Councillor David McCraith said he could see no reason to refuse the application, and Councillors Sebastian Kindersley and Deborah Roberts agreed.

 

The Committee approved the application subject to the Conditions set out in the report from the Planning and New Communities Director.

The Committee approved the application subject to the Conditions set out in the report from the Planning and New Communities Director, amended as follows:

 

·       In Condition (e), by deleting the words “…of the access…” and replacing with the words “…of both accesses…”

 

·       In Condition (f), by deleting the words “The new vehicular accesses and parking areas to the existing dwelling…” and replacing with the words “The two new vehicular accesses and parking areas proposed” and deleting the words “…(known as no. 2 High Street, Harston)…”.

 

·       In Condition (g), by deleting the words “…72 South End…” and replacing with the words “…no. 2 High Street, Harston”.

·           £3,917.76 towards the provision of community facilities prior to occupation of the third dwelling

·           £556 towards the provision of household waste receptacles prior to occupation of the first dwelling

·           A Primary school contribution of £13,440

The Committee refused the application contrary t the recommendation in the report from the Planning and New Communities Director.  Members agreed the reasons for refusal as being that the application was contrary to planning policies, particularly Policy DP/7 of the South Cambridgeshire Local Development Framework concerning development frameworks, being outside the village envelope and encroaching upon the open countryside.

The Committee gave officers delegated powers to approve the application subject to the prior completion of a legal agreement under Section 106 of the Town and Country Planning Act 1990 requiring that 40% of the net gain in the number of dwellings is affordable, and requiring financial contrinutions towards education, public open space, community facilities, household waste receptacles and Section 106 monitoring (all based on net gain), and the Conditions referred to in the report from the Planning and New Communities Director.

The Committee approved the application, contrary to the recommendation in the report from the Corporate Manager (Planning and New Communities).  Reasons for approval: Members considered that the high standard of energy efficiency and renewable energy provision and a commuted sum in respect of affordable housing would outweigh any conflict with Policy HG/2 (Housing Mix).  The Committee did not consider the Local Highways Authority advice sufficiently strong to justify refusal, taking into account the relatively low volume of traffic and the absence of road accidents in the vicinity.  Members gave officers delegated powers to negotiate and complete a Section 106 Legal Agreement and to finalise planning Conditions.
