28/05/2021 - 20/03802/FUL - Orchard Park (Development Parcel L2, Topper Street)

By seven votes to four, the Committee approved the application subject to

 

1.    the prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 based on the Heads of Terms set out in paragraph 145 of the report from the Joint Director of Planning and Economic Development, it being clarified that the £58,000 for informal open space would be spent on existing open space; and

 

2.    the Conditions and Informatives set out in the report from the Joint Director of Planning and Economic Development.


16/10/2020 - S/4243/19/FL - Orchard Park (Land to the West of Neal Drive)

By seven votes to four, the Committee gave officers Delegated authority to approve the application subject to

 

1.    The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 securing the items outlined in Appendix 2 to the report from the Joint Director of Planning and Economic Development; and

 

2.    The Conditions and Informatives set out in that report.

 

(Councillors John Batchelor, Bradnam, Cahn,  Daunton, Fane, Hawkins and Rippeth voted to support the application. Councillors Roberts, Heather Williams, Richard Williams, and Wright voted against.


28/08/2020 - S/4191/19/FL - Orchard Park (Western Side Of Land Parcel COM4, Neal Drive)

Councillor Pippa Heylings proposed an amendment and addition as set out in 2 (a) and (b) below. This was seconded by Councillor Anna Bradnam and, upon a vote being conducted by roll call, the Committee approved both the amended Condition and additional Informative by eight votes to one with one abstention.

 

(Councillors John Batchelor, Bradnam, Cahn, Fane, H\awkins, Heylings, Wilson and Wright voted in favour. Councillor Roberts voted against. Councillor Richard Williams abstained.)

 

The Committee gave officers delegated authority to approve the application, subject to

 

1.    The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 securing

 

a.     A 15-year clawback mechanism in relation to affordable housing

b.     Implementation and maintenance of a car club scheme

c.     Developer Contributions towards community facilities (but excluding the cycleway contribution sought by Cambridgeshire County Council)

 

2.    The Conditions and Informatives set out in the report, subject to

 

(a)  Condition 5 being re-worded as follows

 

The pedestrian link on land within the Applicant’s ownership, between Neal Drive and Chieftain Way, as shown on the approved Site Plan OP/170/2 Rev 1 shall be constructed and made available for public use prior to first occupation of the approved development. The pedestrian link within the Applicant’s ownership, shall thereafter be retained in accordance with the approved plans and shall remain accessible to the general public at all times unless otherwise agreed in writing with the Local Planning Authority. The pedestrian link within the Applicant’s ownership shall be maintained to a standard sufficient for public use as proposed.

 

(b)  An additional Informative that would satisfy the concerns raised by the landscape officer that the details submitted in relation to the soft and hard landscaping (as required by Condition 6) shall provide a high-quality landscape that overcomes the objections raised.

17/07/2019 - S/0768/18/FL - Orchard Park (Western side of land parcel COM 4)

By ten votes to nil, with Councillor Sue Ellington abstaining, the Planning Committee refused the application contrary to the recommendation in the report from the Joint Director of Planning and Economic Development. Members agreed the reason for refusal as being:

 

·         Conflict with South Cambridgeshire District Council Local Plan Policy HQ/1 (Design Principles)

·         Conflict with the Orchard Park Design Guidance SPD (2011)

·         Conflict with Local Plan Policy NH/14 (Biodiversity)

 


17/07/2019 - S/3983/18/FL - Orchard Park (Western side of land parcel COM 4)

The Planning Committee unanimously refused the application contrary to the recommendation in the report from the Joint Director of Planning and Economic Development. Members agreed the reasons for refusal as being

 

1.    That the application was contrary to Policy HQ/1 of the South Cambridgeshire Local Plan 2018 and, specifically, the following criteria therein, namely

·         Criterion A - Preserve and enhance the character of the local urban and rural area and respond to its context in the wider landscape

·         Criterion C - Include variety and interest with a coherent, place-responsive design, which is legible and creates a positive sense of place and identity whilst also responding to the local context and respecting local distinctiveness

·         Criterion D - Be compatible with its location and appropriate in terms of scale, density, mass, siting, design, proportion, materials, texture and colour in relation to the surrounding area.

·         Criterion E - Deliver a strong visual relationship between buildings that comfortably define and enclose streets, squares and public places, creating interesting vistas, skylines, focal points and appropriately scaled landmarks along routes and around spaces;

 

2.    That the design of the proposed development would be contrary to the Orchard Park Design Guidance Supplementary Planning Document 2011;

 

3.    That the landscaping/planting proposals illustrated on the submitted plans did not provide high quality landscaping which integrated the development with its surroundings and the landscaping and planting measures which had been proposed were not considered to be viable. The development would therefore be contrary to Local Plan Policy HQ/1(m).

 

4.     That insufficient information had been submitted to enable the Local Planning Authority to determine whether there would be harm to protected species.


03/02/2017 - S/1294/16/FL - Orchard Park (L2, Topper Street)

The Committee gave officers delegated powers to approve the application subject to

 

1.     The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 securing

 

a.     £75,000 towards improvements to cycle facilities on Arbury Road

b.     £12,000 towards outside gym equipment at the Community Centre

c.      £23,805 towards refurbishment and improvement of the facilities at Arbury Road surgery

d.     £9,450 towards household waste bins (£150 per unit)

e.     £1,200 monitoring fee

f.       A Scheme of 40% affordable housing

 

2.   The Conditions set out in the report from the Head of Development Management, Condition 18 being reworded to state as follows

                       

There shall be no retail or commercial related deliveries to the approved development outside the hours of 07:00 to 19:00 hours (Monday to Saturday) and 09:00 to 17:00 hours (Sundays, Bank and Public Holidays) unless otherwise agreed in writing by the Local Planning Authority.

(Reason: To protect the amenity of the adjoining and nearby properties in accordance with Policy DP/3 of the adopted Local Development Framework 2007.)

07/04/2016 - S/3223/15/FL - Orchard Park (K1, Topper Street)

The Committee gave officers delegated powers to approve the application subject to:

 

1.     The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 securing

 

a.     A financial contribution towards education;

b.     A financial contribution towards waste recycling and waste receptacles;

c.     Affordable housing; and

d.     An obligation to reduce car parking provision based on the establishment of a car club, but subject to extra demand for car parking from time to time

 

2.     The Conditions set out in the report from the Planning and New Communities Director, subject to the following amendment and additions:

 

Condition amended:

 

(k)        Prior to commencement of any residential development, a detailed noise mitigation / insulation scheme for the residential units, to protect future occupants internally from Kings Hedges Road and the Cambridge Guided Busway traffic noise, shall be submitted to and approved in writing by the Local Planning Authority. The detailed noise attenuation / insulation scheme shall have regard to the internal noise levels recommended in British Standard 8233:2014 “Sound Insulation and noise reduction for buildings-Code of Practice” and, in seeking to achieve the recommended levels, to the noise insulation of the composite building fabric, glazing areas, including the provision of sound attenuated alternative mechanical ventilation systems (or similar) to facilitate rapid / purging ventilation and thermal comfort / summer cooling requirements if the “reasonable” indoor ambient noise levels in BS 8233 cannot be achieved with a partially open external window (assuming a -13dB(A) external to internal reduction for a partially open window).  The traffic noise attenuation / insulation scheme as approved shall be fully implemented prior to occupation and shall be retained thereafter and not altered without prior approval.

(Reason: To ensure that sufficient noise attenuation / mitigation is provided to all residential properties to protect future occupiers internally from the impact of traffic noise and safeguard the health, amenity and quality of life of future residents in accordance with paragraphs 109, 123 of the National Planning Policy Framework 2012 and Policy NE/15 Noise Pollution of the adopted Local Development Framework 2007.)

 

Conditions added

 

(l)         No development shall commence until a programme of measures to minimise the spread of airborne dust (including the consideration of wheel washing and dust suppression provisions) from the site during the construction period or relevant phase of development has been submitted to and approved in writing by the Local Planning Authority. Works shall be undertaken in accordance with the approved details / scheme unless the local planning authority approves the variation of any detail in advance and in writing.

(Reason - To protect the occupiers of adjoining buildings (dwellings) from the effect of dust in accordance with Policy NE/16 of the adopted Local Development Framework 2007.)

 

(m)       No development (including any pre-construction, demolition or enabling works) shall take place until a comprehensive construction programme identifying each phase of the development and confirming construction activities to be undertaken in each phase and a timetable for their execution submitted to and approved in writing by the Local Planning Authority in writing.  The development shall subsequently be implemented in accordance with the approved programme unless any variation has first been agreed in writing by the Local Planning Authority.

(Reason - To protect the amenities of residential properties in accordance with Policies NE/15,  NE/16 and DP/6 of the adopted Local Development Framework 2007.)

 

3.     The Informatives set out in the said report, subject to the following additions:

 

Bonfire informative

 

During construction there shall be no bonfires or burning of waste on site except with the prior permission of the Environmental Health Officer in accordance with best practice and existing waste management legislation.

 

General Informative

 

A ‘catch all’ informative could be attached advising the applicant to have consideration of South Cambridgeshire District Council Supplementary Planning Document - “District Design Guide: High Quality and Sustainable Development in South Cambridgeshire”.

The Committee approved the application as amended, subject to the prior completion of a Section 106 Legal Agreement relating to the issues mentioned in paragraph 134 of the report to the Planning Committee dated 6 June 2012, varied so as to allow for a greater share of the total sum of £921,020.00 to be allocated to pre-school provision, and to the Conditions and Informatives set out in the report from the Planning and New Communities Director dated 1 August 2012.
