PAPWORTH EVERARD: Planning Applications

15/04/2021 - 20/02098/S106a - Papworth Everard (Land between Church Lane and Ermine Street South, Church Lane)

By six votes to three, the Planning Committee refused the application contrary to the recommendation in the report from the Joint Director of Planning and Economic Development. Members agreed that the proposed variation to the Legal Agreement under Section 106 of the Town and Country Planning Act 1990 would fail to secure the delivery of the community building in a timely manner, resulting in up to 40 dwellings being occupied without adequate community provision. Consequently the proposal would be contrary to Policy H/4 of the South Cambridgeshire Local Plan 2018, which requires redevelopment of Papworth Everard West Central to secure a mix of community, employment and housing uses; and Policies SC/4 and SC/6 which require all housing developments to contribute towards the provision of indoor community facilities to meet the need generated by the development.

 

(Councillors Hawkins, Heylings, Rippeth, Roberts, Heather Williams and Wright voted to refuse the application. Councillors Bradnam, Cahn and Fane voted to approve it. Councillors Henry Batchelor and Richard Williams were not present and did not vote.)

The Committee refused the application contrary to the recommendation in the report from the Joint Director for Planning and Economic Development. Members agreed the reasons for refusal as being:

 

1.     Sustainability, and scale of the proposed development in relation to the extent of the existing village; and

2.     Landscaping and visual impact


03/11/2016 - S/2647/15/OL - Papworth Everard (Land to the East of Old Pinewood Way and Ridgeway)

In the light of recent Appeal decisions relating to the Council’s inability to demonstrate a five-year housing land supply, and upon the Chairman’s casting vote, the Planning Committee gave officers delegated powers to approve the application subject to

 

1.     The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 securing the obligations referred to in the Heads of Terms attached as Appendix 3 to the report from the Head of Development Management; and

 

2.     The Conditions and Informatives set out in an update report from the Head of Development Management, published on 28 October 2016 as part of a supplement to the main agenda.

The Committee gave officers delegated powers to approve the application, subject to:

 

1.     The prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 securing the delivery of an acceptable number of affordable dwellings onsite; and

 

2.     The Conditions and Informative set out in the report from the Head of Development Management.

06/02/2015 - S/1691/14/FL - Papworth Everard (Crows Nest Farm, Ermine Street)

The Committee approved the application, subject to the Conditions referred to in the report from the Planning and New Communities Director, and to the following Informatives:

 

1.    Public Byway No.2 Papworth must remain open and unobstructed at all times (it is an offence under Section 137 of the Highways Act 1980 to obstruct a public Highway).

2.    No alteration to the footpath surface is permitted without consent from Cambridgeshire County Council (it is an offence to damage the surface of a public footpath under s 1 of the Criminal Damage Act 1971).

3.    Landowners are reminded that it is their responsibility to maintain hedges and fences adjacent to public rights of way, and that any transfer of land should account for any such boundaries (Section 154 Highways Act 1980).

4.    The granting of planning permission does not entitle a developer to obstruct a public right of way (Circular 1/09 para 7.1).

The Committee approved the application for a temporary period of three years in order to reassess the impact of the development on the surrounding conservation area.

The Committee gave officers delegated powers to approve the application subject to the prior completion of a Unilateral Undertaking to reflect the legal obligations set out in the previous planning approval (S/1424/08/RM) and the Conditions referred to in the report from the Planning and New Communities Director.

The Committee gave officers delegated powers to approve the application , subject to the prior completion of a Legal Agreement under Section 106 of the Town and Country Planning Act 1990 to secure delivery of the community building (in consultation with the Parish Council), 15% on-site affordable housing, the Local Area for Play (LAP) and financial contributions towards education, outdoor play space and householder waste receptacles, and to the Conditions referred to in the report from the Planning and New Communities Director presented to the Planning Committee on 4 September 2013.

04/09/2013 - S/0623/13/FL & S/0624/13/CA - Papworth Everard (Land between Church Lane and Ermine St South)

The Committee deferred the application so that officers could negotiate further with the applicant over the terms of the Section 106 Legal Agreement, and clarify the precise nature of the ‘Live / Work’ units.

The Committee gave officers delegated powers to approve the application subject to any adverse impact on the amenity of neighbours being addressed satisfactorily by Condition, the Conditions referred to in the report from the Planning and New Communities Director, an additional Condition restricting deliveries to and collections from the site to between 8.00am and 6.00pm Monday to Friday and between 8.00am and 1.00pm on Saturday (with no deliveries or collections at all on Sunday) unless in accordance with a noise management scheme to be agreed with the Local Planning Authority.
