The Sub-Committee has considered your application, as amended by yourself at the meeting, very carefully and has had due regard to the Licensing Act 2003, the accompanying Guidance and Regulations and the SCDC Licensing Policy.  We have heard the evidence from the Applicant, the Police, Milton Parish Council and one of the local district councillors and two of the local residents present at the hearing and considered the written submissions of additional representees including the Council’s Environmental Health Officer.

 

The Sub-Committee noted the Home Office amended guidance of April 2012 which states that `Licensing Authorities are expected to accept all reasonable recommendations from the Police unless there is clear evidence to the contrary’. Having heard the amended representations from the applicant, Sgt Rogerson on behalf of the Police withdrew his previous objections to the application and supported the amended application without objections.

 

Some of the local residents had concerns about nuisance parking off the premises; however, this is outside the jurisdiction of this Council.

 

We have decided to grant the licence application, as amended by the applicant at the hearing, on the basis outlined in the table above and subject to the conditions listed below which we have decided to attach to promote the licensing objectives and agreed to by the applicant at the hearing.

 

1.            To prevent potential disturbance to nearby residents, no new customers shall be permitted onto the premises after 23:00. Clear, legible signs to indicate this shall be placed in prominent positions close to the entrances of the premises.

 

2.            Clear and legible notices shall be displayed close to any exit doors and in the car park  reminding patrons that the premises are located in close proximity to residential dwellings and that they leave the premises and the area quickly and quietly to minimise any disturbance to nearby residents.

 

3.            No licensable activity shall take place in the front garden between 22:30 and 08:00.

 

4.            The placing of bottles into receptacles outside the premises shall only take place between 10:00 and 18:00 to minimise disturbance to nearby properties.

 

5.            There will be no amplified music played on the premises at any time.

 

6.            A register of entry refusals and incidents inside or outside the premises shall be maintained, kept up to date and readily available for inspection by the Police or authorised Council officers.

 

7.            To participate in any existing local Pub Watch scheme to the satisfaction of the local police authority.

 

8.            To adopt a relevant approved age policy authorised by the local Police authority.

 

 

Local residents may apply for a review of the licence on a ground relating to one or more of the licensing objectives should there be any relevant issues arising from the operation of the new premises licence at any stage after the date of this decision notice.  We hope that local residents will feel able to bring any future concerns directly to the attention of the licensees in an effort to reach an amicable solution to any future problems.  The four licensing objectives are: the Prevention of Crime and Disorder; Prevention of Public Nuisance; Public Safety; and Protection of Children from Harm.

 

The applicant and objectors have a right of appeal to the Cambridge Magistrates’ Court within 21 days of receiving notification of this decision.
