 Councillor SGM Kindersley declared a general personal interest as a Cambridgeshire County Councillor, particularly in respect of Minutes 162 (Cambridgeshire Guided Busway) and 163 (Barrington, a parish covered by his County Council electoral division of Gamlingay).

To authorise the Chairman to sign the Minutes of the meeting held on 1 April 2009 as a correct record.  These minutes have been published, and are available on the Council’s website.

The Committee agreed that, in the resolution relating to Minute no. 152 (Planning Sub-Committee – Future Arrangements), the words “…settled and traveller communities…” should be replaced with the words “…the public…” , and that the word “those” should be deleted.  The resolution would now read as follows

The Committee instructed officers to revise the Planning Sub-Committee’s terms of reference for consideration at the meeting on 6 May 2009 (if practicable) and develop a scheme of public speaking for members of the public wishing to address the Sub-Committee.

Subject to this amendment, the Committee authorised the Chairman to sign the minutes as a correct record.

The Committee noted its resolution of 9^th January 2008 (minute no. 144 refers) to approve the outline planning application and the hazardous substance consent application as amended by letter and plans date stamped 15^thJune 2007, and voted to approve each application subject to Conditions and to the prior completion of the Section 106 Agreement, substantially in those terms drafted in paragraphs 40 and 41 of the current report from the Corporate Manager (Planning and Sustainable Communities) and in Appendix 4.

Dr James (objector), Ian Reid (on behalf of the applicant), Dr Barbara Fagg (Hinxton Parish Council) and Councillor Tony Orgee (Member for the Abingtons) addressed the meeting in respect of the Draft Report on Public Health Risks prepared by Dr. James.  Ian Reid and Councillor Orgee also addressed the meeting in respect of planning conditions and the Section 106 Legal Agreement.

Copies of a letter dated 5 May 2009 from Richard Buxton (Environmental and Public Law – Cambridge) were distributed to Members, and the Chairman adjourned the meeting for a short time to enable them to consider its contents.  Members also received expert advice from the Health and Safety Executive, Environment Agency and South Cambridgeshire District Council’s Health Protection Team Leader.  A proposal from Councillor Roberts, seconded by Councillor Nightingale, to defer the applications in order to seek independent third party advice about the associated risks was put to the Committee and defeated. The Committee approved each application subject to Conditions and, in relation to planning application S/1749/06/O, to the prior completion of a Section 106 Legal Agreement, substantially in those terms drafted in paragraphs 40 and 41 of the current report from the Corporate Manager (Planning and Sustainable Communities) and in Appendix 4 to that report, but with the deletion from the Section 106 Agreement of the Junction Safety Assessment and the addition to the Cycleway Contribution of the cost of the Junction Safety Assessment.

Councillor Janice Guest declared a personal interest because her husband, now retired, had been employed by Hexel and was in receipt of a pension from that company.

Councillor John Williams declared a personal interest because of his acquaintance with many residents in Duxford and by virtue of his familiarity with the chemical industry and toxicology acquired as part of his past career.

Councillor Deborah Roberts voted to refuse the applications.

 The Committee approved the application subject to the Conditions referred to in the report from the Corporate Manager (Planning and Sustainable Communities) and an additional Condition requiring the submission of an acceptable scheme of maintenance relating to off-site public open space.

Mr Bullen (objector), Chris Anderson (applicant’s agent), David Thurman  (Histon Parish Council) and Councillor Mike Mason (a local member) addressed the meeting.

The Committee approved the application subject to the Conditions referred to in the report from the Corporate Manager (Planning and Sustainable Communities) and an additional Condition requiring the submission of an acceptable scheme relating to off-site public open space.

The Committee refused the application contrary to the recommendation in the report from the Corporate Manager (Planning and Sustainable Communities).  Members agreed the reasons for refusal as being the non-sustainability of the site and its failure to meet the criteria relating to exception sites for affordable housing as contained in Policy HG/5 of the South Cambridgeshire Local Development Framework 2007.

Brian Ing (Impington Parish Council) and Councillor Mike Mason (a local member) addressed the meeting.

The Committee refused the application contrary to the recommendation in the report from the Corporate Manager (Planning and Sustainable Communities).  Members agreed the reasons for refusal as being an unsustainable site and its failure to meet the criteria relating to exception sites for affordable housing as contained in Policy HG/5 of the South Cambridgeshire Local Development Framework 2007.

The Committee discharged Condition 3(a)(iii) and (vi) in regard to the design and external appearance for the B1050 Park and Ride junction and the Longstanton Park and Ride site in accordance with the amended drawings submitted by letters dated 23February and 12March 2009 and subject to final submission and approval of detailed landscaping for the screen planting on the east side of the B1050 and completion of the dedicated bus, foot and cycleway connections to Northstowe in accordance with an agreed timescale.  Cambridgeshire County Council agreed to mark a ‘Keep Clear’ area adjacent to the property known as ‘Southwell’.

Prior to considering this application, the Committee attended a site visit on 6 May 2009.  The Committee deferred the application in order to further establish what is to be determined by the Local Planning Authority and the requirements of Cambridgeshire County Council, and to allow more time to identify potential planning conditions.

The Committee approved the application contrary to the recommendation in the report from the Corporate Manager (Planning and Sustainable Communities).  Members agreed the reasons for approval as being the proposal’s compliance with Policies HG/1 and DP/2 of the South Cambridgeshire Local Development Framework 2007.

Dr. Richard Horne (applicant), Councillor Robin Martlew (local member) and Councillor Steve Harangozo (the Member for Comberton) addressed the meeting.

The Committee approved the application contrary to the recommendation in the report from the Corporate Manager (Planning and Sustainable Communities).  Members agreed the reasons for approval as being the proposal’s compliance with Policies HG/1 and DP/2 of the South Cambridgeshire Local Development Framework 2007 in that development of more than one dwelling would not be in keeping with the pattern and character of development along this side of West Street.
